Terms and Conditions
These terms and conditions apply to the website nextcrm.ai, the NextCRM waitlist and the NextCRM software service. Please read them carefully.
Version of 19 October 2026
1. Provider and scope
The provider is Michael Papst, sole proprietorship, Viktor-Franz-Straße 24, 8051 Graz, Austria, e-mail info@nextcrm.ai (“we”). These terms apply to the use of the website nextcrm.ai, to the NextCRM waitlist and – once it is available – to the NextCRM software service (“service”). Deviating or supplementary terms of our customers do not apply, even if we do not expressly object to them.
2. Website and pre-launch information
The website informs about NextCRM. Its content, in particular features, plans, limits and prices before launch, is not a binding offer and may change until a contract is concluded. Illustrations show example data. We take care to keep the information correct and up to date but cannot guarantee that it is complete at all times. Links to third-party websites are provided for information; their operators are responsible for their content.
3. Waitlist
Joining the waitlist is free of charge and does not oblige you to buy anything. It gives no right to access the service, to a particular launch date or to particular conditions. After you confirm your e-mail address (double opt-in), we inform you about the launch of NextCRM. You can unsubscribe at any time with the link in every e-mail. We may end the waitlist at any time. Details on data processing are in our privacy policy.
4. Who may use the service
The service is intended exclusively for entrepreneurs within the meaning of § 1 of the Austrian Consumer Protection Act (KSchG) and comparable persons in other countries, who use it for their business. By ordering, you confirm that you act as an entrepreneur. Consumers may join the waitlist but cannot conclude a contract for the service.
5. Conclusion of contract and services
The contract is concluded when you create a workspace in the NextCRM app, choose a plan and we confirm the order. The scope of services results from the plan and any add-ons booked at the time of ordering, as described in the app. Some features require your own accounts with third-party providers (for example Twilio, Meta or your own AI provider); their terms apply to those accounts.
We may develop the service further and change features, provided the essential functions of your plan are not impaired and the change is reasonable for you. We will inform you in good time about changes that affect you significantly.
6. Prices, payment and term
The prices of the plan and add-ons shown in the app at the time of ordering apply, plus statutory value added tax where applicable. Fees are charged in advance for the chosen billing period (monthly or yearly) via our payment provider Stripe.
The contract runs for the chosen billing period and renews automatically for the same period unless it is cancelled before the end of the current period. You can cancel in the app at any time with effect at the end of the paid period. We can cancel with 30 days' notice to the end of a billing period. The right of both parties to terminate for good cause remains unaffected.
We will announce price changes at least 30 days before they take effect. If you do not agree, you can cancel the contract until the change takes effect; otherwise the new prices apply from the next billing period.
7. Your obligations
You may use the service only in compliance with the law. In particular you must not send unsolicited advertising (spam) and must observe the rules on electronic marketing, use Lead Intelligence (OSINT) only for lawful business purposes and never for the surveillance of private individuals, upload content that infringes the rights of others, attempt to circumvent security measures, reverse-engineer the software or read it out automatically, or pass on your access to unauthorised persons.
You are responsible for the data you store in NextCRM and for having a legal basis for processing it. For personal data that we process on your behalf, we conclude a data processing agreement under Art. 28 GDPR with you. Keep your access data secret and inform us immediately if you suspect misuse.
We may temporarily block access if there are concrete indications of a serious breach of these obligations or if payments are more than 14 days overdue after a reminder, provided this is reasonable for you. We will inform you of the block and lift it as soon as the reason no longer applies.
8. AI features and Lead Intelligence
Lora and other AI features generate suggestions automatically. They can be incomplete or wrong. Check results before you rely on them; changes to your data are only made after your confirmation. Lead Intelligence researches publicly available business information about companies; the results are not verified and may be outdated.
9. Availability
We strive for high availability of the service. Interruptions due to maintenance, security updates or circumstances beyond our control (such as failures of third-party providers or the internet) are possible. Where possible, we announce planned maintenance in advance.
10. Warranty
We will remedy defects in the service within a reasonable time after you report them. You must report defects promptly, describing them as precisely as possible. The statutory warranty applies with the restrictions permitted between entrepreneurs.
11. Liability
We are liable without limitation for damage caused intentionally or through gross negligence and for personal injury. In the case of slight negligence, our liability is excluded to the extent permitted by law. Liability for lost profits, indirect and consequential damages and for data loss beyond the cost of restoring data from backups that you should reasonably have made is excluded, except in the case of intent or gross negligence. In all other cases, our liability is limited to the fees you paid in the 12 months before the damaging event. These limitations also apply to our employees and vicarious agents.
12. Your data at the end of the contract
You can export your data at any time. After the contract ends, we keep your data for 30 days so that you can export it, and then delete it, unless we are legally obliged to keep it longer.
13. Changes to these terms
We may change these terms for objectively justified reasons, for example changes in the law or in the service. We will send you the changes at least 30 days before they take effect. If you do not object before then, the changes are deemed accepted; we will point this out separately in our notice. If you object, either party may terminate the contract at the time the changes take effect.
14. Final provisions
Austrian law applies, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. The exclusive place of jurisdiction for disputes with entrepreneurs is the competent court in Graz, Austria. For consumers (waitlist), mandatory consumer protection rules of the country in which they have their habitual residence remain unaffected.
Should individual provisions of these terms be or become invalid, the remaining provisions remain valid. These terms are available in several languages; in the event of contradictions, the German version prevails.
